By downloading, installing, accessing, or using the Inhale application ("App"), you ("User," "you," or "your") agree to be bound by these Terms of Use ("Terms"). If you do not agree to all of these Terms, you must immediately stop using the App and delete it from your device. These Terms constitute a legally binding agreement between you and Aleksei Bukhalov ("Developer," "we," "us," or "our").
Inhale is a breathing exercise application designed solely for general wellness and relaxation purposes. It provides guided breathing techniques with visual animations, procedurally generated ambient sounds, and haptic feedback. The App is provided on an "as available" basis, and we reserve the right to modify, suspend, or discontinue any part of the App at any time without prior notice or liability.
THE APP IS NOT A MEDICAL DEVICE. The App is not intended to and does not provide medical advice. It is not intended to diagnose, treat, cure, mitigate, or prevent any disease, disorder, or health condition. The breathing exercises and related content provided in the App are for general wellness and informational purposes only and should not be considered a substitute for professional medical advice, diagnosis, or treatment.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APP IS AT YOUR SOLE RISK. Breathing exercises may cause dizziness, lightheadedness, hyperventilation, shortness of breath, or other adverse effects. You should consult with a qualified healthcare professional before using the App if you have any medical condition including but not limited to: cardiovascular disease, respiratory conditions, epilepsy, pregnancy, panic disorder, or any condition that may be affected by controlled breathing patterns.
If you experience any discomfort, dizziness, pain, or difficulty breathing while using the App, stop immediately and seek medical attention if necessary. By using the App, you represent that you are in adequate physical and mental health to perform breathing exercises and that you voluntarily assume all risks associated with such use.
You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18 (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms.
The App offers auto-renewable subscriptions and a one-time lifetime purchase ("Premium Features"). Current pricing is displayed on the subscription screen within the App and on the Apple App Store. Prices may vary by region and are subject to change.
Payment is charged to your Apple ID account upon confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions at any time through your device settings (Settings → Apple ID → Subscriptions). Free trials and introductory offers, if any, automatically convert to the full subscription price unless cancelled before the trial or introductory period ends. Any unused portion of a free trial will be forfeited upon purchase of a subscription.
All purchases are processed by Apple Inc. and are subject to Apple's terms and conditions. Refund requests must be directed to Apple. We do not have the ability to process refunds directly. This App is licensed to you under Apple's Standard End User License Agreement (EULA), unless a custom EULA is provided.
All content, features, functionality, design, graphics, animations, sounds, code, trademarks, trade names, and branding in the App are and shall remain the exclusive property of Aleksei Bukhalov or his licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or disassemble any part of the App.
You agree not to: (a) use the App for any unlawful purpose; (b) attempt to gain unauthorized access to the App's systems or networks; (c) reverse-engineer, decompile, or disassemble the App; (d) remove, alter, or obscure any proprietary notices in the App; (e) use the App in any manner that could interfere with, disrupt, or impose an undue burden on the App or its infrastructure.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER, HIS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; (C) ANY HEALTH EFFECTS RESULTING FROM YOUR USE OF BREATHING EXERCISES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO THE DEVELOPER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN US DOLLARS ($10.00), WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless the Developer from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your use of the App caused damage to a third party.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the competent courts of Belgrade, Republic of Serbia, and you consent to the personal jurisdiction and venue of such courts. Notwithstanding the foregoing, the Developer may seek injunctive or equitable relief in any jurisdiction to protect intellectual property rights.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with the Privacy Policy and Apple's Standard EULA, constitute the entire agreement between you and the Developer regarding the App and supersede all prior agreements, understandings, and communications, whether written or oral.
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. The Developer's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
We reserve the right to modify these Terms at any time at our sole discretion. Changes will be posted on this page with a revised "Last updated" date. Your continued use of the App after any modifications constitutes your binding acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
